These Terms & Conditions govern your use of earthsvoice.com, operated by Earth’s Voice, a nonprofit organization based in Montgomery, Alabama (“Earth’s Voice,” “we,” “us,” or “our”). By using this website, you agree to these terms. If you do not agree, please do not use the site.

Nature of our programs and services

Earth’s Voice provides education, coaching, consulting, and programming focused on personal growth and wellness, curriculum and educational support, family and community work, and food, land, and events. Our work is collaborative and forward-looking. You remain responsible for your own decisions, actions, and results.

What we provide is not psychotherapy, mental health counseling, psychiatric treatment, medical care, substance abuse treatment, nutritional therapy, legal advice, financial or investment advice, tax advice, or accounting services. We are not acting as your licensed counselor, therapist, physician, attorney, or financial advisor, and nothing on this website or in a program engagement creates any of those relationships.

Nothing on this site should be taken as a diagnosis or as treatment for any condition. If you are experiencing a mental health or medical concern, please consult a licensed professional. If you are in crisis, contact your doctor, go to your nearest emergency room, or call or text 988 in the United States to reach the Suicide & Crisis Lifeline.

No guaranteed results

Outcomes depend on many factors, most of them within your control rather than ours. We make no promise or guarantee of any particular result, income, outcome, or improvement. Any examples, case descriptions, or testimonials on this site reflect individual experiences and are not a prediction of what you will experience.

Eligibility

You must be at least 18 years old to use this website or to enter into an agreement with us. Where a program involves a minor, a parent or legal guardian must contract for and consent to that participation.

Program engagements

Information on this site about our programs and services is general and for informational purposes. It is not an offer and does not create an agreement between us.

Programs and engagements are arranged individually. The specific scope, schedule, deliverables, fees, and payment terms for any engagement are set out in a written agreement signed by both parties. That signed agreement controls the terms of that engagement, and where it conflicts with these Terms & Conditions, the signed agreement governs.

Fees and payment

Fees and payment schedules vary by engagement and are established in the applicable written agreement. Any figures shown on this website are general and subject to change.

Refunds

Fees for programs, sessions, or services already delivered are non-refundable.

If you cancel a program or engagement before it begins, we will refund any prepaid fees for work not yet delivered, less any non-recoverable costs already incurred on your behalf, such as materials, travel, or third-party fees.

If we cancel a program or are unable to deliver services you have paid for, you will receive a full refund of fees for the undelivered portion.

To request a refund, email info@earthsvoice.com with your name, the program or engagement, and the reason for the request. Approved refunds are issued to the original payment method within 30 days. Where a signed agreement sets out different refund terms, that agreement governs.

Donations

Donations to Earth’s Voice are voluntary and, once processed, are generally non-refundable. If a donation was made in error, in a duplicate transaction, or as the result of an unauthorized use of your payment method, contact us at info@earthsvoice.com within 30 days and we will review the request.

Donations support our general operations and programs unless you designate a specific purpose and we agree in writing to that designation. We reserve the right to redirect restricted funds where the designated purpose becomes impractical, consistent with applicable law and our governing documents.

Earth’s Voice does not provide tax advice. Please consult your own tax advisor regarding the deductibility of any contribution. [IF 501(c)(3): We will provide written acknowledgment for contributions of $250 or more, as required by IRS rules.]

Confidentiality

We treat what you share with us in a program or engagement as confidential and will not disclose it without your permission, except where disclosure is required by law, is necessary to prevent serious harm to you or another person, or involves suspected abuse or neglect of a child or vulnerable adult, which we may be legally required to report.

Communications with us are not legally privileged. Unlike communications with a licensed therapist or attorney, our conversations are not protected from disclosure in legal proceedings.

Intellectual property

All content on this website — text, images, graphics, logos, curriculum materials, frameworks, and design — is owned by Earth’s Voice or used with permission, and is protected by copyright and other intellectual property laws.

You may view and print content for your own personal, non-commercial use. You may not copy, republish, distribute, sell, or create derivative works from our materials without our written permission. Materials provided to you during an engagement are licensed for your own use only and may not be redistributed or taught to others as your own.

Your use of the site

You agree not to use this website to transmit anything unlawful, harassing, defamatory, or infringing; to attempt to gain unauthorized access to the site or its systems; to interfere with the site’s operation; or to collect information about other users. We may restrict or terminate access at our discretion.

Anything you submit through this site — comments, form submissions, or other content — you confirm you have the right to submit. You grant us permission to use it as needed to respond to you and operate the site.

Third-party links

This site may link to websites we do not control. We provide those links for convenience only. We do not endorse and are not responsible for the content, products, or practices of any third-party site.

Disclaimer of warranties

This website and its content are provided “as is” and “as available,” without warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. Limitation of liability

To the fullest extent permitted by law, Earth’s Voice, its directors, officers, employees, contractors, and volunteers will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for lost profits, lost revenue, or lost data, arising out of your use of this website or our programs and services, whether based in contract, tort, or any other theory, even if we have been advised of the possibility of such damages.

To the fullest extent permitted by law, our total liability for any claim arising out of or relating to this website or our programs and services will not exceed the amount you paid us in the three months preceding the event giving rise to the claim, or $100, whichever is greater.

Some jurisdictions do not allow certain limitations of liability, so some of these limits may not apply to you.

Indemnification

You agree to indemnify and hold harmless Earth’s Voice, its directors, officers, employees, contractors, and volunteers from any claims, losses, liabilities, and expenses, including reasonable attorneys’ fees, arising out of your use of this website, your violation of these terms, or your violation of the rights of any third party.

Governing law and disputes

These terms are governed by the laws of the State of Alabama, without regard to its conflict of law rules. Any dispute arising out of or relating to these terms or your use of this website will be brought exclusively in the state or federal courts located in Montgomery County, Alabama, and you consent to the jurisdiction of those courts.

Changes to these terms

We may update these Terms & Conditions at any time. Changes take effect when posted, and we will update the “Last updated” date at the top of this page. Your continued use of the site after a change means you accept the revised terms.

Severability and entire agreement

If any provision of these terms is found unenforceable, the remaining provisions stay in effect. These terms, together with our Privacy Policy and any signed engagement agreement, are the entire agreement between us regarding this website.
